By accessing or using the Forma mobile application ("App") and related services (collectively, "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Forma LLC ("Forma," "we," "us," or "our").
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years old. To access certain features, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process.

Forma provides information for educational and informational purposes only. We are not a medical organization, and our staff cannot give you medical advice or diagnosis. Nothing contained in the App or Services should be construed as such advice or diagnosis.
The information and reports generated by us should not be interpreted as a substitute for physician consultation, evaluation, or treatment. You are urged and advised to seek the advice of a physician before beginning any weight loss effort, exercise regimen, or diet. This App is intended for use only by healthy adult individuals. The App is not intended for use by minors, pregnant women, or individuals with any type of health condition. Such individuals are specifically advised to seek professional medical advice prior to initiating any form of weight loss effort or regimen.

Forma is currently offered as a free application. However, we reserve the right to introduce paid features or subscription models in the future. Any future payments, subscriptions, or in-app purchases will be subject to the terms of the respective App Store (Apple App Store or Google Play Store). You agree to pay all fees and applicable taxes incurred by you or anyone using an account registered to you. Refunds are handled by the respective App Store and are subject to their refund policies.
All content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Forma, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Our Services may allow you to post, upload, or otherwise make available content, including photos of meals, comments, and profile information ("User Content"). You retain all rights in your User Content. However, by uploading User Content, you grant Forma a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and improving the Services.
You agree not to use the Services:
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL FORMA, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to defend, indemnify, and hold harmless Forma, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
We reserve the right to terminate or suspend your access to all or part of the Services for any or no reason, including without limitation, any violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of New Mexico.
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
